There is hereby incorporated by reference for the purpose of establishing employee personnel rules and regulations the document entitled “Uniform Personnel Policies and Guidelines for the City of Solomon.”       No fewer than three copies of said document shall be marked or stamped “Official Copy as adopted by the Code of the City of Solomon” and which there shall be attached a copy of this section. Said official copies shall be filed with the city clerk and shall be open to inspection and available to the public at all reasonable hours. All departments of the city shall be supplied with copies of such rules and regulations as may be deemed necessary.

The city will provide and pay the full amount of the employee’s part of the group insurance plan as selected by the governing body for all full time employees. Coverage for employee family members may be included in the plan providing the employee is agreeable to deduct the amount of premium from his or her wages.

The city hereby extends the benefits of Title II of the Federal Social Security Act, in conformity with the applicable provisions of said act, to the employees of the city, in accordance with and under terms of the plan agreed to with the state agency.

The city shall indemnify and pay on behalf of each person and the heirs or legal representatives of such person who is or was an officer or employee of the city for any reasonable expense that may be incurred by such person in connection with or resulting from any claim, action, suit or proceeding, civil, criminal, administrative, or investigative, or threat thereof, or in connection with an appeal relating thereto, in which such person may become involved as a party or otherwise while acting within the scope of his/her employment. The payment of such expense shall be supplemental to any expense incurred by any insurance company under the company’s contractual obligation to the city, or to the individual.

As used in this article, the term “expense” includes counsel fees, and other disbursements made or to be made in assisting in the defense of such person and may include payment of judgements, fines, penalties, or amounts paid in settlement by or on behalf of such person.

The governing body shall not be liable as provided in section 1-404 whenever it shall find:

(a)   The act or omission was not within the scope of the employee’s employment;

(b)   Such employee acted or failed to act because of actual fraud or actual malice;

(c)   The defense of the action or proceeding by the city would create a conflict of interest between the city and the employee.

In lieu of furnishing legal counsel as authorized by this article, the city may pay the premiums on insurance protecting its officers and employees in the event of such suit and providing for the defense of any such action.

(a)   The governing body of the city hereby elects to bring the city of Solomon under the provisions of K.S.A. 75-4321 to 75-4337, inclusive, and amendments thereto.

(b)   It is expressly declared that the city does hereby reserve to itself any and all management rights as explicitly set forth in K.S.A. 75-4326.

(a)   The city, in accordance with the provisions of K.S.A. 12-16,102 as amended, does hereby establish an employee benefits contribution fund for the purpose of paying the city’s share of employee benefits prescribed by subsection (b).

(b)   The cost of employee benefits authorized for payment from the fund created by subsection (a) shall include the following: Employer contributions for social security, worker’s compensation, unemployment insurance, health care costs, employee benefit plans, and employee retirement and pension programs.
